§ 1 DEFINITIONS

 

Working days – days from Monday to Friday, excluding public holidays.
Account – a free function of the Store (a service provided electronically) regulated by separate regulations, thanks to which the Buyer can set up their individual Account in the Store.
Consumer – a consumer within the meaning of the provisions of the Civil Code.
Buyer – any entity purchasing in the Store.
Regulations – these regulations.
Store – the online store Tiles - Ceramic and Stone Tiles run by the Seller at https://stonetiles.pl/.
Seller – TILES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at ul. Kartuska 214/0.16, 80-122 Gdańsk, entered into the National Court Register - the register of entrepreneurs by the DISTRICT COURT OF GDAŃSK-PÓŁNOC IN GDAŃSK, 7th COMMERCIAL DIVISION OF THE NATIONAL COURT REGISTER, under KRS number 0000776646, NIP 5833346506, REGON number 38284514100000, share capital PLN 50,000.00 

Entrepreneur with Consumer Rights - a natural person concluding a sales agreement directly related to their business activity, when it results from the content of this agreement that it does not have a professional character for this person, resulting in particular from the subject of the activity performed by them economic.

§ 3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, you need:
    • a device with Internet access
    • a web browser that supports JavaScript and cookies.
  2. To place an order in the Store, in addition to the requirements specified in sec. 1, an active e-mail account is required.

§ 4 PURCHASES IN THE STORE

  1. The prices of goods visible in the Store are the total prices for the goods, including VAT.
  2. The Seller points out that the total price of the order consists of the prices indicated in the Store: the price for the goods and, if applicable in a given case, the costs of packaging and delivery of the goods.
  3. The goods selected for purchase should be added to the basket in the Store.
  4. The Buyer then selects from the options available in the Store: the method of delivery of the goods and the method of payment for the order, and also provides the data necessary to complete the placed order.
  5. The order is placed at the moment of confirmation of its content and acceptance of the Regulations by the Buyer.
  6. Placing an order is identical to concluding a sales agreement between the Buyer and the Seller.
  7. The Seller will provide The consumer will receive confirmation of the conclusion of the sales agreement on a durable medium no later than 7 days after delivery of the goods. The consumer agrees to electronic documents.
  8. The buyer can register in the Store, i.e. create an Account there or make purchases without registration by providing their data with each possible order.

§ 5 PAYMENTS

  1. The order can be paid for, depending on the Buyer's choice:
    1. By regular transfer to the Seller's bank account.
    2. By payment card:
      • Visa
      • Visa Electron
      • MasterCard
      • MasterCard Electronic
      • Maestro
    3. Through the platform payment:
      • PayPal
      • PayU
    4. By card or cash upon personal collection of goods.
  2. Through payment platforms:  PayPal, - PayU, - imoje, operated by ING Bank Śląski S.A. with its registered office in Katowice.
  3. In pn the case of the Buyer choosing payment in advance, the order must be paid for within 1 Business Day of placing the order.
  4. The Seller informs that in the case of some payment methods, due to their specificity, payment for the order using this method is only possible immediately after placing the order.

§ 6 ORDER COMPLETION

  1. The Seller is obliged to deliver the goods without defects.
  2. The order completion date is indicated in the Store.
  3. In the event that the Buyer chose payment in advance for the order, the Seller will start processing the order after it has been paid for.
  4. In the event that the Buyer purchased goods with different completion dates within one order, the order will be completed within the time appropriate for the goods with the longest completion date.
  5. The goods are delivered only within the territory of the Republic of Poland.
  6. The goods purchased in the Store are delivered depending on the delivery method chosen by the Buyer:
    1. Via courier company
    2. Via Polish Post
    3. To InPost parcel lockers
  7. The Buyer can collect the goods in person at the company's headquarters during its opening hours.
  8. If the Buyer chooses personal collection, the goods will be ready for collection on the indicated date of order fulfillment, and if the Seller has indicated a date for sending the goods - on that date.

§ 7 RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. The Consumer has the right to withdraw from the contract concluded with the Seller via the Store, subject to § 8 of the Regulations, within 14 days without giving any reason.
  2. The deadline for withdrawal from the contract expires after 14 days from day:
    1. on which the Consumer came into possession of the goods or on which a third party other than the carrier and indicated by the Consumer came into possession of the goods.
    2. on which the Consumer came into possession of the last item or on which a third party, other than the carrier and indicated by the Consumer, came into possession of the last item in the case of an agreement requiring the transfer of ownership of multiple items that are delivered separately.
    3. conclusion of the agreement - in the case of an agreement for the delivery of digital content.
  3. In order for the Consumer to exercise the right to withdraw from the agreement, they must inform the Seller, using the data provided in § 2 of the Regulations, of their decision to withdraw from the agreement by means of an unequivocal statement (e.g. a letter sent by post or information sent by e-mail).
  4. The Consumer may use the model withdrawal form placed at the end of the Regulations, but this is not obligatory.
  5. To meet the deadline to withdraw from the contract, it is sufficient for the Consumer to send information regarding the exercise of his right to withdraw from the contract before the deadline for withdrawal from the contract expires.
  6. The right to withdraw from the contract is also available to a natural person - an Entrepreneur with the rights of a Consumer, concluding a contract directly related to his business activity, when it results from the content of this contract that it does not have a professional character for this person, resulting in particular from the subject of the business activity performed by him, made available on the basis of the provisions on the Central Register and Information on Business Activity.
  7. In the event of withdrawal from the contract, the Consumer and the Entrepreneur with the rights of a Consumer shall bear the direct costs of returning the goods, unless the Seller agrees to cover them. In the event of a return due to a defect in the goods, the cost of return shall be borne by the Seller.


    CONSEQUENCES OF WITHDRAWAL FROM THE CONTRACT
  8. In the event of withdrawal from the concluded contract, the Seller shall return to the Consumer all payments received from him, including the costs of delivering the goods (with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard method of delivery offered by the Seller), immediately, and in any case no later than 14 days from the day on which the Seller was informed of the Consumer's decision to exercise the right to withdraw from the contract.
  9. The Seller shall return the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution; in each case, the Consumer shall not incur any fees in connection with this return.
  10. The Seller may withhold the return of the payment until the goods are received or until proof of their return is provided to him, depending on which event occurs first.
  11. The Seller requests that the goods be returned to the following address: ul. Kartuska 214/0.16, 80-122 Gdańsk immediately, and in any case no later than 14 days from the date on which the Consumer informed the Seller of the withdrawal from the sales contract. Termmin is maintained if the Consumer returns the goods before the expiry of the 14-day period.
  12. The Consumer shall bear the direct costs of returning the goods.
  13. The Consumer shall be liable only for a decrease in the value of the goods resulting from their use in a manner other than necessary to establish the nature, characteristics and functioning of the goods.
  14. If the goods cannot be returned by ordinary post due to their nature, the Consumer shall also bear the direct costs of returning the goods. The Consumer will be informed about the estimated amount of these costs by the Seller in the description of the goods in the Store or when placing the order.
  15. In the event of the need to return funds for a transaction made by the Consumer with a payment card, the Seller will make a refund to the bank account assigned to that payment card.

§ 8 EXCEPTIONS FROM THE RIGHT TO WITHDRAW FROM THE CONTRACT

  1. The right to withdraw from a contract concluded at a distance does not apply to the Consumer in relation to the contract:
    1. in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or intended to meet their individual needs.
    2. in which the subject of the service is an item that quickly spoils or has a short shelf life.
    3. in which the subject of the service is an item delivered in sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.
    4. where the subject of the service are items which, due to their nature, are inseparably connected with other items after delivery.
    5. where the subject of the service are audio or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery.
    6. for the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement.
    7. where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires.
    8. for the delivery of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the Consumer before the deadline for withdrawal from the contract expires and after the entrepreneur informed him of the loss of the right to withdraw from the contract agreement.

§ 9 COMPLAINTS

  1. In the event of a defect in the goods, the Buyer may file a complaint about the defective goods on the basis of the warranty or guarantee regulated in the Civil Code, provided that the guarantee has been granted.
  2. Using the warranty, the Buyer may, on the terms and within the deadlines specified in the Civil Code:
    1. submit a declaration of price reduction
    2. in the case of a significant defect - submit a declaration of withdrawal from the agreement
    3. demand the exchange of the item for a defect-free one
    4. demand the removal of the defect
  3. The Seller requests that complaints be filed on the basis of the warranty to the postal or e-mail address indicated in § 2 of the Regulations.
  4. If it turns out that the consideration of the complaint, it is necessary to deliver the complained goods to the Seller, the Buyer is obliged to deliver this goods, in the case of the Consumer at the Seller's expense, to the address ul. Kartuska 214/0.16, 80-122 Gdańsk.
  5. If an additional guarantee has been granted for the goods, information about it, as well as its terms, is available in the product description in the Store.
  6. Complaints regarding the operation of the Store should be sent to the e-mail address indicated in § 2 of the Regulations.
  7. The complaint will be considered by the Seller within 14 days.
  8. Complaints can be submitted in the following manner:
    1. In writing to the following address: ul. Kartuska 214/0.16, 80-122 Gdańsk.
    2. By e-mail to the address: info@tiles.com.pl.

    The Seller shall be liable to the Consumer and the Entrepreneur with the rights of the Consumer for the lack of conformity of the Goods with the sales agreement existing at the time of its delivery and revealed within two years from the date of delivery of the goods.

    The Seller shall consider complaints within 14 days of their submission. If the complaint requires delivery of the goods, the Seller shall cover the delivery costs in the case of Consumers and Entrepreneurs with the rights of the Consumer.



    OUT-OF-COURT METHODS OF RESOLVING COMPLAINTS AND FINDING CLAIMS
  9. In the event that the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others, from:
    1. mediation conducted by the relevant Voivodship Inspectorate of Trade Inspection, to which you should apply for mediation. As a rule, the proceedings are free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
    2. the assistance of the competent permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application for consideration of the case before the arbitration court should be submitted.     3. free assistance from the municipal or district consumer ombudsman.
    4. online ODR platform available at: http://ec.europa.eu/consumers/odr/.

§ 10 PERSONAL DATA

  1. The Seller is the administrator of personal data provided by the Buyer when using the Store.
  2. The Buyer's personal data are processed mainly on the basis of the contract and for the purpose of its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Seller is included in the privacy policy posted in the Store.

§ 11 DISCLAIMERS

  1. The Buyer is prohibited from providing content of an illegal nature.
  2. Each order placed in the Store constitutes a separate sales agreement and requires separate acceptance of the Regulations. The agreement is concluded for the time and for the purpose of fulfilling the order.
  3. Agreements concluded on the basis of these regulations are concluded in Polish.
  4. No provision of these regulations excludes or in any way limits the rights of the Consumer resulting from the provisions of law.
  5. The provisions regarding goods and the sales agreement shall apply accordingly to digital content and the agreement for the supply of digital content, unless the Regulations specify these issues separately.

§ 12 PROVISIONS REGARDING BUYERS WHO ARE NOT CONSUMERS

  1. The right to withdraw from a distance contract does not apply to any entity other than the Consumer.
  2. Any liability of the Seller towards the Buyer who is not a Consumer is limited to the amount of the order placed by the Buyer.
  3. The Seller's liability for warranty in relation to a Buyer who is not a Consumer is limited to one year from the date of delivery of the goods to the Buyer.
  4. In the event of a potential dispute with a Buyer who is not a Consumer, the competent court will be the court with jurisdiction over the Seller's registered office.

§ 3 TECHNICAL REQUIREMENTS

  1. For the proper functioning and creation of the Account, the following is required:
    • active e-mail account
    • device with Internet access
    • internet browser supporting JavaScript and cookies

§ 4 ACCOUNT

  1. Creating an Account is completely voluntary and depends on the will of the Buyer.
  2. The Account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of orders or independent editing of Buyer's data.
  3. In order to create an Account, fill out the appropriate form in the Store.
  4. When creating an Account, an agreement is concluded for an indefinite period between the Buyer and the Seller regarding the management of the Account on the principles specified in these regulations.
  5. The Buyer may resign from the Account at any time without incurring any costs.
  6. In order to resign from the Account, send your resignation to the Seller at the e-mail address: info@tiles.com.pl, which will result in immediate deletion of the Account and termination of the agreement regarding the management of the Account.

§ 5 COMPLAINTS

  1. Complaints regarding the functioning of the Account should be sent to the e-mail address info@tiles.com.pl .
  2. The complaint will be considered by the Seller within 14 days.

    OUT-OF-COURT COMPLAINT AND CLAIM SETTLEMENT PROCEDURES
  3. If the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others:
    1. mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
    2. assistance of the competent permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case before the arbitration court should be submitted. § 6 PERSONAL DATA

  1. The administrator of personal data provided by the Buyer when using the Store is the Seller.
  2. The Buyer's personal data are processed mainly on the basis of a contract and for the purpose of its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on the processing of data by the Seller is included in the privacy policy posted in the Store.

§ 7 DISCLAIMERS

  1. The Buyer is prohibited from providing content of an illegal nature.
  2. The Account management agreement is concluded in Polish.
  3. In the event of important reasons referred to in par. 4, the Seller has the right to change these Account regulations.
  4. Important reasons referred to in par. 3 are:
    1. the need to adapt the Store to the legal regulations applicable to the Store's activity
    2. improving the security of the services provided of the service
    3. change in the functionality of the Account requiring modification of the Account regulations.
  5. The Buyer will be informed of the planned change to the Account regulations at least 7 days before the change comes into effect via an e-mail message sent to the address assigned to the Account.
  6. In the event that the Buyer does not accept the planned change, they should inform the Seller by sending an appropriate message to the Seller's e-mail address info@tiles.com.pl, which will result in the termination of the agreement regarding the management of the Account at the time the planned change comes into effect or earlier, if the Buyer makes such a request.
  7. In a situation where the Buyer does not express an objection to the planned change until it comes into effect, it is assumed that they accept it, which does not constitute any obstacle to terminating the agreement in the future.
  8. In the event of a potential dispute with a Buyer who is not a Consumer, the competent court will be the court with jurisdiction for the registered office of Sellers.
  9. No provision of these regulations excludes or in any way limits the Consumer's rights resulting from the provisions of law.






Newsletter regulations

Tiles - Ceramic and Stone Tiles store

§ 1 DEFINITIONS

Newsletter - a free service provided electronically, thanks to which the Service Recipient may receive previously ordered messages regarding the Store from the Service Provider electronically, including information about offers, promotions and new products in the Store.

Service Provider - TILES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at ul. Service Recipient - any entity using the Newsletter service.

§ 2 Newsletter

  1. The Service Recipient may voluntarily use the Newsletter service.
  2. To use the Newsletter service, a device with the latest version of a web browser supporting JavaScript and cookies, with access to the Internet and an active e-mail account is required.
  3. E-mails sent as part of this service will be sent to the e-mail address provided by the Service Recipient when signing up for the Newsletter.
  4. In order to conclude an agreement and sign up for the Newsletter service, the Service Recipient first provides their e-mail address in the designated place in the Store, to which they wish to receive messages sent as part of the Newsletter. Then, to the e-mail address provided in the first step, the Service Provider will send the Service Recipient a message verifying the e-mail address, which will contain a link for the Service Recipient to confirm their will to subscribe to the Newsletter. After the Service Recipient confirms their will to subscribe to the Newsletter, an agreement for the provision of the service is concluded, and the Service Provider will begin providing it to the Service Recipient.
  5. The Service Recipient may unsubscribe from the Newsletter, without giving a reason and incurring any costs, at any time by sending a message to the Service Provider's e-mail address: info@tiles.com.pl.
  6. Sending a message requesting unsubscription from the Newsletter will result in immediate termination of the agreement for the provision of this service.

§ 3 Complaints

  1. Complaints regarding the Newsletter should be reported to the Service Provider at the e-mail address: info@tiles.com.pl.
  2. Service Provider will respond to the complaint within 14 days of receiving the complaint.

§ 4 Personal data

  1. The administrator of personal data provided by the Service Recipient when using the Newsletter is the Service Provider.
  2. The Service Recipient's personal data are processed mainly on the basis of the contract and for the purpose of its implementation, in accordance with the principles set out in the general regulation of the European Parliament and of the Council (EU) on data protection (GDPR). Detailed information on data processing by the Service Provider is included in the privacy policy posted in the Store.

§ 5 Final provisions

  1. The Service Provider reserves the right to change these regulations only for important reasons. An important reason is understood as the need to change the regulations due to the modernization of the Newsletter service or a change in legal regulations that affects the provision of the service by the Service Provider.
  2. Information about the planned change to the regulations will be sent to the e-mail address of the Service Recipient provided at the time of signing up for the Newsletter at least 7 days before the changes come into effect.
  3. If the Service Recipient does not object to the planned changes until they come into effect, it is assumed that they accept them.
  4. In the event of non-acceptance of the planned changes, the Service Recipient should send information about this to the Service Provider's e-mail address: info@tiles.com.pl, which will result in termination of the service agreement when the planned changes come into effect.
  5. The Service Recipient is prohibited from providing content of an illegal nature.
